We, at The K Learning Academy (hereinafter collectively referred to as “KLA”), are committed to respecting your online privacy and recognize the need for appropriate protection and management of any personally identifiable information you share with us. This Privacy Policy (“Policy“) describes how KLA collects, uses, discloses and transfers personal information of users through its websites and applications, including through www.kpathway.com, mobile applications and online services (collectively, the “Platform”). This policy applies to those who visit the Platform, or whose information KLA otherwise receives in connection with its services (such as contact information of individuals associated with KLA including partners) (hereinafter collectively referred to as “Users”). For the purposes of the Privacy Policy, “You” or “Your” shall mean the individual / group / institution / university / college / corporate / employer / counselor but not limited to, who is accessing the Platform.

  1. Types of Personal Information collected by KLA
    “Personal information” (PI) – means any information relating to an identified or identifiable natural person / group / company / corporate / employer / college / university but not limited to, including common identifiers such as a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, academic, professional or social identity of that natural person and any other information that is so categorized by applicable laws. We may collect information about you and/or your usage to provide services and offerings. The Personal Information that we may collect, and how we collect it, depends upon how you interact with us. We collect the following categories of Personal Information in the following ways but the same can be changed from time to time as per business / legal requirements:

    • Training – First & last name or name, company/organization (if you are associated with),country, address, city, state, pincode, phone number, email id, user name, password.
    • Career guidance – First & last name or name, company/organization (if you are associated with),class, school, stream, country, address, city, state, pincode, phone number, email id, user name, password.
    • V Campus –
  • Students – profile image, Name, address, city, state, pincode, email, contact number, college (in which he/she is studying or studied), degree, course, course duration, marks, projects, documents (like mark sheet, project report, profile image, resume, certificates etc), password, but not limited to.
  • College – Name of the college, address, city, state, pincode, email, contact number, degree & related courses offered, password.
  • Employer – Name of the employer, address, city, state, pincode, email, contact number, industry, any other information, password.
  • information that one would usually include in a resume, including name, contact details including e-mail address and mobile number, work experience, educational qualifications, data relating to your current and past remuneration or salary, a copy of your resume, etc. when you register on the Platform;
  • information about the services that you use and how you use them, including log information with IP address, when you are a user of the services through the Platform;
  • we may collect your Personal Information such as name, age, contact details, preferences, etc. through surveys and forms, when you choose to participate in these surveys etc.;
  • when you communicate with KLA or use the Platform to communicate with other Users (such as partners), we may collect information about your communication and any information you choose to provide;
  • when you visit the Platform, we may use cookies to automatically collect, store and use technical information about your system and interaction with our Platform;
  • when you use a device to access the Platform, KLA may collect technical or other related information from the device as well as the device location;
  • To the extent permitted by law, KLA may record and monitor your communications with us to ensure compliance with our legal and regulatory obligations and our internal policies. This may include the recording of telephone conversations;
  • If you choose to sign in with your social media account to access the Platform, or otherwise connect your social media account with the services of the Platform, you consent to our collection, storage, and use, in accordance with this Privacy Policy, of the information that you make available to us through the social media interface. Please see your social media provider’s privacy policy and help centre for more information about how they share information when you choose to connect your account.
  1. How KLA may use your Personal Information
    We will only use your personal data in a fair and reasonable manner.

    Our use of your personal data depends on the purpose for which you interact with us. We may process your Personal Information for the following purposes:
  • Providing our services and products to you including to send you various alerts,  relevant search results, and other social media communication facilities;
  • Protecting our Users and providing you with customer support;
  • We use information collected from cookies and other technologies, to improve the user experience and the overall quality of our services (for more information please refer to paragraph 4 below). When showing you tailored ads, we will not associate an identifier from cookies or similar technologies with sensitive categories, such as those based on race, religion, sexual orientation or health.

  • Conducting market research and surveys with the aim of improving our products and services.
  • Sending you information about our products and services for marketing purposes and promotions;

4. Cookies and Other Tracking Technologies

  • Some or all of our web pages may utilize “cookies” and other tracking technologies. A “cookie” is a small text file that may be used, for example, to collect information about web-site activity. Some cookies and other technologies may serve to recall Personal Information previously indicated by a user. WE may use cookies and other tracking technologies for purpose (but not limited to) like improve our Platform, overall website experience etc. We may also analyze information that does not contain Personal Information for trends and statistics.

  1. The Basis/ Grounds which we rely on for collection and processing of your Personal Information:

    Your Personal Information is collected and processed by KLA based on the following legal grounds depending upon the nature of Personal Information and the purposes for which it is processed.
  • Providing service:

KLA shall collect required data in order to deliver the service (either paid or free) for which any user has registered for, which could be training, career guidance program, v campus etc. but not limited to.

  • Consent:

    KLA will ask for agreement of our privacy policy, terms & conditions & consent during any registration process. Incase not asked during registration, it is deemed considered that the subscriber have gone through our privacy policy, terms & conditions, consent & agrees to accept & abide by it. KLA relies on your consent in order to process your Personal Information in certain situations.
  • Compliance with a legal obligation:

    Your Personal Information may be processed by KLA, to the extent that such processing is necessary to allow KLA to comply with a legal obligation. An example of this would be if KLA is required to disclose your Personal Information to respond to a court order or if KLA is required to retain specific records for a fixed period to comply with requirements under any applicable law.
  1. Information Sharing and Disclosure

    We restrict access to your Personal Information to employees who we believe reasonably need to know/or that information to fulfil their jobs to provide, operate, develop, or improve our products or services.

    KLA does not disclose, transfer or share your Personal Information with others except with:

  • Our affiliates and group companies to the extent required for our internal business and/or administrative purposes and/or general corporate operations and for provision of delivering our services.
  • Third parties including enforcement, regulatory and judicial authorities, if we determine that disclosure of your Personal Information is required to a) respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims; or b) investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of KLA’s Terms of Use or as otherwise required by law;
  • In the event of a merger, acquisition, financing, or sale of assets or any other situation involving the transfer of some or all of KLA’s business assets we may disclose Personal Information to those involved in the negotiation or transfer.
  • Third party service providers and marketing partners that KLA engages to a) provide services over the Platform on KLA’s behalf; b) maintain the Platform and mailing lists; or c) communicate with you on KLA’s behalf about offers relating to its products and/or services. KLA shall take reasonable steps such that these third-party service providers are obligated to protect your Personal Information and are also subject to appropriate confidentiality / non-disclosure obligations.
  • Third party advertisers to display advertisements to you when you visit the Platform. The third-party advertisers include financial service providers (such as banks, insurance agents, stock brokers and mortgage lenders) and non-financial companies (such as stores, airlines, and software companies). These companies may use information about you and your visits to this Platform and other web sites to provide advertisements on this Platform.

The Company does not provide any Personal Information to the advertiser when you interact with or view a targeted advertisement. However, if you interact with or view an advertisement, the advertiser may get information if you fill some form or may make certain assumptions and, in the process, learn certain Personal Information about you. For instance, if you view and click an advertisement that is targeted towards women in the age group 18- 24 from a specific geographic area, the advertiser may assume that you meet the relevant criteria.

KLA does not intend to transfer Personal Information without your consent to third parties who are not bound to act on KLA’s behalf unless such transfer is legally required.

If your Personal Information is transferred outside India, we shall take the necessary steps to protect your Personal Information in accordance with applicable data protection laws.

Sharing information with counselor, employer

 School Student’s data (who have registered for career guidance program) will be shared with Career Counselors for career guidance service. Career Counselor will interact with the allocated student for further process & completion of career guidance program service. We urge students / parents not to share any information or document with the Counselor that you may feel is not relevant to the career guidance work. We do have control over any data being shared between Counselor & student/parent and hence will not be liable under any circumstances for any data breach and/or misuse of the same.

  • College student’s data (who have registered on V Campus) – Employers (who have registered on V Campus) will get access to the data of college & its students. The employers may personally contact the student for their recruitment process. We urge students / candidates to take following care:
    • Not to share any information or document with the employer that you may feel is not relevant with the recruitment process.
    • In case if you have to share any information / document which is asked by the employer, please ensure you share only through proper route like email etc. but after due verification.
    • Be very cautious if any employer ask for money or any favour as generally, no employer asks for money or favour in return of job.

We do have any control over any data being shared between Student, college & employers nor any mechanism to trace the sharing of data, and hence will not be liable under any circumstances for breach and/or misuse of any data.

7.Third Party Content:

  • Please be aware that the Platform sometimes contains links to other sites that are not governed by this Privacy Policy. Users may be directed to third-party sites for more information, such as advertisers, blogs, content sponsorships, vendor services, social networks, etc. or for receiving payments through payment gateways for purchasing our service/s.
  • KLA makes no representations or warranties regarding how your information is stored or used on third-party servers. We recommend that you review the applicable privacy statements and policies of each third-party site linked from our Platform to determine their use of your personal information.

8.Age restrictions

  • To use the Platform, you agree that you must be the minimum age (described in this paragraph below) or older. However if local laws require that you must be older for KLA to be able to lawfully provide the services over the Platform to you then that older age shall apply as the applicable minimum age.
    • For Career Guidance Program – The minimum age for these purposes shall be fourteen (14).
    • For Trainings – The minimum age for these purposes shall be eighteen (18).
    • For V Campus – The minimum age for these purposes shall be eighteen (18).
  • If you are under the age of 14 or the age of majority in your jurisdiction, you must use the Platform under the supervision of your parent, legal guardian or responsible adult.

 

9. Retention of Personal Information

  • Your Personal Information will be retained by KLA till it is necessary for the purposes for which the Personal Information is processed and/or in accordance with legal, regulatory, contractual or statutory obligations as applicable.

10.Controlling your personal information

 

  • You have the right to invoke your rights which are available to data principals or data subjects (as per applicable laws and regulations) in relation to your Personal Information which is being processed by KLA. After revoking the rights, the data may not be available in public domain but will be archived by us for purpose like govt enquiry etc but not limited to.
  • KLA provides you the ability to keep your Personal Information accurate and up-to-date. If at any time you would like to a) rectify, update or correct your Personal Information; b) obtain confirmation on whether or not your Personal Information is processed by it; c) exercise your right to restrict the continuing disclosure of your Personal Information to any third party / user by KLA you are requested to contact us using the contact details mentions in this section below. We will require you to provide a valid proof of your identity, in order to ensure that your rights are respected. The disclosure restriction can only be done through deleting your account, so please ensure you wish to do so before placing such request.
  • At any time, if you wish to delete your account on kpathway.com, you may do so sending us an email from your registered email only to info@kpathway.com with subject as “Delete Account” with a valid id proof. We will keep a copy of your account information under archived information till the time permitted / required by the law.
  • For the exercise of certain rights, you may be required to approach the relevant authority / designated officer as per the provisions of the applicable data protection laws. KLA may in accordance with the provisions of applicable data protection laws, charge a fee for fulfilling your request, in particular in case of excessive or manifestly unfounded request. Further you acknowledge that the above mentioned rights are not absolute and are subject to limitations as per the applicable data protection laws.

 

11.Confidentiality and Security

  • The security and confidentiality of your Personal Information is important to us and KLA has invested significant resources to protect the safekeeping and confidentiality of your personal data. When using external service providers acting as processors, we require that they adhere to the same standards as KLA does. Regardless of where your Personal Information is transferred or stored, we take steps reasonably necessary & feasible, to ensure that personal data is kept secure.
  • We seek to ensure compliance with the requirements of the Information Technology Act, 2000 and Rules made there under to ensure the protection and preservation of your privacy. We have electronic (SSL) and procedural (limited access to staff) safeguards that comply with the laws prevalent in India to protect your Personal Information. By accepting the terms of this Privacy Policy, you agree that the standards and practices being implemented by us, are reasonable and sufficient for the protection of your Personal Information.

12.Social media

  • KLA operates channels, pages and accounts on some social media sites to inform, assist and engage with customers. KLA monitors and records comments and posts made on these channels about itself in order to improve its products and services.
  • Please note that you must not communicate any of your personal information to KLA through such social media sites except name & general comments. We urge to communicate with us only through this email id – info@kpathway.com. KLA is not responsible for any information posted on those sites leading to privacy issues.

13.Changes to this Privacy Policy

  • KLA reserves the right to update, change or modify this Privacy Policy at any time.
  • The Privacy Policy shall come to effect from the date of publication of such update, change or modification.
  • KPathway may or may not be able to inform the users about any changes that may take place, hence we request users / subscribers to frequently visit our privacy policy, terms & condition links in order to keep oneself updated.
  • It is understood that the sections of privacy policy, terms & condition have been read, acknowledged & agreed by the users / subscribers in  order to continue usage of services at KPathway.

14.Disclaimer

  • KLA uses service of payment gateway providers for receiving payments. They are the third party service providers & we do not have any control over how your data (like personal information, payment details like card number etc) is stored / processed / used / transferred etc. Kindly read their privacy policy for more information. Also, In case of any payment related issues, please contact your payment clearing agency (bank etc) as we do not handle any payment issues. 
  • KLA shall not be liable for any loss or damage sustained by Users as a result of any disclosure (inadvertent or otherwise) of any information concerning the User’s account, payment modes (like credit or debit cards, wallets, UPI etc) in the course of any online transactions or payments made for any products and/or services offered through the Platform.

16.Media:

  • If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
  • WE do not have any service which requires any video upload, hence beware & avoid any such requests.
  • The document to be uploaded will have size limitation, so please ensure the documents are of required size only, else system shall not allow to upload the document.

17.Comments:

  • When visitors leave comments on the site we may collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
  • An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. h. What are Web Beacons?

The subscription of a user shall be subject to Quotas as applicable and as advised. E-Mails provided as part of contact details are expected to be genuine and access to such email accounts is available to authorized personnel only.

The K Learning Academy shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the user’s account and / or information relating to or regarding online transactions using financial instruments like credit cards, debit cards, UPI etc and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed (including OTP) and used whether or not in pursuance of a legal process or otherwise.

Payments for the services offered by Www.kpathway.com shall be on a 100% advance basis. We do not have any refund policy. Refund if any will be at the sole discretion of KPathway. KLA offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts. KLA gives no guarantees of server uptime or applications working properly. All is on a best effort basis. KLA undertakes no liability for free services. KLA reserves its right to amend / alter or change all or any disclaimers or terms of agreements at any time without any prior notice. All terms / disclaimers whether specifically mentioned or not shall be deemed to be included if any reference is made to them.

Unless otherwise specified and notwithstanding anything contained in any other agreement or arrangement, by whatever name called, the performance obligation of KLA (service provider) is to provide access of its on-line portal to the customer for the duration of the subscription period & reference to any usage, by whatever name called or any other performance obligation, if any, is to provide the upper limit for consumption, which by itself, does not create any additional performance obligation upon KLA

Subscriber/user acknowledges and agrees that KLA/Www.kpathway.com, at its sole discretion and without prejudice to other rights and remedies that it may have to, under the applicable laws, shall be entitled to set off the amount paid or payable by a subscriber/user against any amount(s) payable by Subscriber/user to KLA under any other agreement or commercial relationship towards other products/services.

The K Learning Academy further reserves its right to post the data on the website www.kpathway.com or on such other affiliated sites and publications as The K Learning Academy may deem fit and proper at no extra cost to the subscriber / user.

The subscription / agreement between KLA and the subscriber / user is not a “non-poach agreement” nor can the same be termed or used as an alternative to “non-poach agreement” in any manner, as KLA / www.kpathway.com is a public site and all information posted by KLA goes to the public domain except information / data which is specifically assigned a non-public / private character.

Any agreement for a subscription / usage entered into by KLA does not confer exclusivity of service on any subscriber / user.

The K Learning Academy will not be party to any legal proceedings between a user (e.g. a subscriber) and a party contracted through the site. In case The K Learning Academy is implicated in any legal proceedings, costs will be recovered from the party that names The K Learning Academy. KPathway however will abide with any court order served on it through due process. KLA controls and operates this Platform from its headquarters in Vadodara and makes no representation that the materials on www.kpathway.com are appropriate or available for use in other locations. If you use this Website from other locations, you are responsible for compliance with applicable local laws including but not limited to the export and import regulations of other countries.

The Terms and conditions mentioned above regulate the usage of www.kpathway.com. Any person/group/corporate/employer but not limited to, using www.kpathway.com in violation of the stipulations contained in the Terms and Conditions of www.kpathway.com shall render itself liable to appropriate action in a court of law both civil and criminal.

WE ARE NOT REGISTERED WITH GST AS OF NOW AND HENCE THE PRICE / FEES DO NOT INCLUDE GST. WE MAY START CHARGING GST AS & WHEN WE REGISTER FOR GST. ANY ADDITIONAL TAX LIABILITY ARISING ON ACCOUNT OF INTRODUCTION OF ANY OTHER TAX APART FROM GST (WHETHER ON ACCOUNT OF INCREASE IN RATE OR ANY CHANGE BROUGHT IN BY THE NEW TAX REGIME) WOULD BE RECOVERED OVER AND ABOVE THE AGREED CONTRACT PRICE / SERVICE FEE.

If any dispute arises between a user/users and KLA arising out of use of Www.kpathway.com or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these Terms and Conditions, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by the Company. Decision of the arbitrator shall be final and binding on both the parties to the dispute. The place of arbitration shall be Vadodara, Gujarat, India. The Arbitration & Conciliation Act, 1996 as amended, shall govern the arbitration proceedings.

These Terms and Conditions shall be governed by the laws of Republic of India. The exclusive forum for any disputes arising out of or relating to these Terms of Use shall be a court of law located in Vadodara, Gujarat, India.

KPathway, KLA and The K Learning Academy are used interchangeably and are synonymous.

In case of non compliance of these Terms and Conditions or Privacy Policy KLA may terminate usage rights and take down any offending information that might have been uploaded by such subscriber/user and without any refund either full or part of the fees paid.

ADDITIONALLY, BASIS SERVICES CHOSEN, CERTAIN PRODUCT/SERVICE SPECIFIC CONDITIONS MAY APPLY.

A) Professional Training.

Live Sessions.

  1. The information/data fed by the user can be updated / modified by the user alone. KPathway can update the data on user’s behalf, but with written request through their registered email only & with specific mention of which data to be changed / deleted / added etc. The user needs to verify the content before sending it to KPathway. KPathway offers such support to the users but exempts itself from any sort of responsibility arising out of accessing the user’s account (like data issue, errornous data etc).   2. KPathway would not be held liable for loss of any data – technical or otherwise, or of the information/data or particulars supplied by user due to acts of god as well as reasons beyond its control like corruption of data or delay or failure to perform as a result of any cause(s) or conditions that are beyond KPathway’s reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.
  3. It shall be sole prerogative and responsibility of the user to check the authenticity of all or any of the information/data fed into the network system of KPathway by the user through registration during the purchase of the service/s. KPathway assumes no responsibility in respect thereof and expressly disclaims any liability for any act, deed or thing which the user may so do, pursuant to their own registration.
  4. Registration for any training as an individual means only one person would be eligible to attend the training & subsequently will receive training participation certificate on the name which was used for registration. Sharing of training link with others & leading to multiple participants attending the training, would be considered as breach of terms & conditions. KPathway can block the registered user with immediate effect & the user will not be allowed to attend the remaining training. Also, the amount paid would not be refunded nor any certificate be provided.
  5. Design, content etc of ant training course listed on www.kpathway.com is the sole ownership of KPathway only. Recording / taking screenshots or photos of the training are strictly not allowed. Any user found doing this will be expelled from the training session & will not be allowed to attend remaining training course. Also, Kpathway can take legal action against the user & demand for compensation. Compensation value will be solely decided by Kpathway only.
  6. KPathway reserves its right to reject and delete any document/ insertion or information/data fed in by the user without assigning any reason.
  7. This service entitles the user alone i.e the same person, to add modify or change the registration  data / information fed in by him but does not entitle him to share the account / purchase with another person/s which enables them to join the course. This is against KPathway’s policy & shall be considered as violation. KPathway can block users and may not be able to complete the course, nor shall be entitled to get any refund.
  8. Once registered, the sole responsibility of the safe custody of the password shall be that of the subscriber and KPathway shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse or manipulation / changes of user’s data or document/s through misuse of the password and any damage or leak of information and its consequential usage by a third party. KPathway undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password created to the subscriber. Also the user should not share their user id, password & account information with anyone.
  9. You consent to your registration being processed and analyzed by www.kpathway.com according to these terms of use and www.kpathway.com’s Privacy Policy. Www.kpathway.com shall store and process such information for purpose like marketing, business analysis etc.
  10. While www.kpathway.com takes measures to safeguard your information from unauthorized access or inappropriate use, www.kpathway.com does not control the third parties and we are not responsible for their use of information you give to us. Accordingly, you should not post sensitive information or any other information you would not want made public, to any portion of www.kpathway.com or application or to a public website.
  11. By registering at www.kpathway .com for trainings, the user hereby agrees to abide by our privacy policy, t&c & other policies which may be updatedand / or introduced from time to time.
  12. The user represents that he/she is not a minor and is not under any legal or other disability which limits his/her ability to comply with these Terms or to install and use the services subscribed and purchased with minimal risk of harm to you or others. You further represent that you are not registering the products/services for resale to others and will not do so without KPathway’s prior written consent.
  13. All changes / modifications made by the user to the data / information shall take place with immediate effect as the best possible case. But it can take more time than anticipated due to reasons not attributable to kpathway like visitor traffic, multiple users trying to register at same time, multiple user trying to access their account etc. but not limited to. Kpathway.com exempts itself from holding itself responsible for additional time / non updation of changes / modification getting updated, but not limited to,  as you may have anticipated. We request to retry after some time. In case of repeated issues, please write to – info@kpathway.com along with screen shots of error messages.
  14. The term for the purchased training course will be as mentioned in respective course details. The user can purchase other courses in future using same registration & login details.
  15. The user agreement between a user/subscriber and KLA will be treated as having been terminated in the following events: ( i ) On completion of the term for which the user/subscriber engages the services of the website; or ( ii ) In case the user/subscriber violates any of the conditions of this agreement or any other agreement entered into by him with KLA, however, such termination will be at the option and discretion of KLA; or ( iii )On writing and on such terms as agreed to by the parties mutually.
  16. The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website.

Self Learning Courses.

  14. The term for the purchased training course will be as mentioned in respective course details. The user can purchase other courses in future using same registration & login details.

The user agreement between a user/subscriber and KLA will be treated as having been terminated in the following events: ( i ) On completion of the term for which the user/subscriber engages the services of the website; or ( ii ) In case the user/subscriber violates any of the conditions of this agreement or any other agreement entered into by him with KLA, however, such termination will be at the option and discretion of KLA; or ( iii )On writing and on such terms as agreed to by the parties mutually.
  16. The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website.

B) Career Guidance Program

  1. Student/s willing to take up this program should understand the details about the program which is available on our website kpathway.com.
  2. By registering & purchasing this program, it is deemed understood that the user have gone through each and every section of the program along with our privacy policy, terms & conditions & refund policy.
  3. Entire Career Guidance Program is an online program including One to One session. There will not be any personal meeting between Counselor & student / parent.
  4. The registration process requires the student to select 2 counselors as their option 1 & 2, to whom they wish to get counseled from. KPathway shall assign the 1st preferred Counselor to the student. Incase of non availability of 1st choice, the 2nd choice Counselor will be automatically allocated. In rare occasion, there is a possibility that both the Counselors may not be available at your suitable date & time, in that case we will contact you to reschedule dates. If you cannot reschedule dates, we will provide the names of the Counselors that are available & request you to select from the list.
  5. Counselor will get in touch with the student to finalize date & time to take up the program. Student / parent to ensure their availability at scheduled date & time. Rescheduling of date / time is possible only if agreed mutually i.e by Counselor & student / parent.
  6. Career Guidance is a work of judgment which will vary from Counselor to Counselor. Counselors listed on our platform are Certified Career Counselors from iDreamcareer (IDC) & is understood they have understanding about the subject. KPathway do not have any mechanism to verify their experience / knowledge about career guidance nor about the credentials that are mentioned in their profile. They had shown interest to join the kpathway platform as a free will. The basis of allowing them to onboard KPathway platform was their certification from iDC.
  7. The Psychometric Assessment Test has been designed & is being conducted by iDreamcareer.com. Kpathway is only a facilitator & has no role to play in any part of this test (like design, questions, scoring, analysis, technical functioning, report generation etc but not limited to). Also, we do not take any responsibility in case of any errors / false information / wrong analysis of answers etc but not limited to, in reports generated after appearing in test. The system is autonomous i.e. the answers to the questions are interpreted & analyzed by computer program only (without human intervention) and any modification / updation / changes to this system is being taken care by idreamcareer only.
  8. Dashboard – The dashboard & its content is designed, created, monitored, updated by idreamcareer only. Also technical upkeeping, keeping it live 24 x 7 & available for access to registered users is responsibility of idreamcareer only. Any downtime / non accessibility / erroneous information / false information but not limited to will be the sole responsibility of idreamcareer only & KPathway shall have no role to play & exempts itself from any responsibility arising out of these or explicitly not stated.
  9. KPathway is just a facilitator who gets student’s enrollments for career guidance program on behalf of various career counselors & indirectly generates business for them. The role of KPathway ends after the student, who enrolled, is allocated to the career counselor. Further process will be completed by the Counselors. The student needs to give a feedback after completion of the program to KPathway by sending email at – info@kpathway.com mentioning “Career Guidance Feedback” in subject.

It shall be sole prerogative and responsibility of the user to check the authenticity of all or any of the information/data fed into the network system of KPathway by the user through registration during the purchase of the service/s. KPathway assumes no responsibility in respect thereof and expressly disclaims any liability for any act, deed or thing which the user may so do, pursuant to their own registration.

  • Any college / student / employer who wish to use this service needs to register on our platform with required details. This service is not available for non-registered users.

College –

  1. The information/data fed by the user can be updated / modified by the user alone. KPathway can update the data on user’s behalf, but with written request through their registered email only & with specific mention of which data to be changed / deleted / added etc. The user needs to verify the content before sending it to KPathway. KPathway offers such support to the users but exempts itself from any sort of responsibility arising out of accessing the user’s account (like data issue, erroneous data etc).   6. The user shall be sent email verification link during registration process. Also, they need to set their account login password by clicking to the link. This shall enable the user to access and upload their college details & subsequently enroll their own students. Once registered, the sole responsibility of the safe custody of the password shall be that of the subscriber and KPathway shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse or manipulation / changes of user’s data or document/s through misuse of the password and any damage or leak of information and its consequential usage by a third party. KPathway undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password created to the subscriber.   8. The user will not be given any preferential placement in the college listings. The updation / creation of dropdown college list will take place only through system, without human intervention & as per alphabetical order – A to Z only.
  9. By registering at www.kpathway .com for V Campus, it is understood that the user have read our privacy policy, terms & conditions etc & hereby acknowledges & agrees to abide by it.
  10. We do not have any mechanism to disable the visibility of any user on our platform once they get registered. Hence the user has to be sure they wish to take up this service. The only option to hide visibility would be to delete your profile.
  11. In case the user wish to delete their profile, they can do so but they will also loose the data of their registered students. Once deleted, the user cannot access their dashboard & listed data. The user needs to go through all the process of registration again including enrolling their students if it wished to enroll again. KPathway do not have any mechanism to retrieve your registration once deleted. To delete the profile & all the content, the user have to place request for the same through their registered email id only to Kpathway. We shall proceed with the deletion after receipt of the email only. The email should be sent to – info@kpathway.com with subject as “Deletion of account”
  12. User needs to be vigilant while registering themselves & their students & filling in their respective data – name, batch, degree, course, email etc. Student will receive an email of verification & generation of password.
  13. College also needs to take utmost steps such that any profile of student is not created which do not exist (dummy) or students which are not studying in your college.
  14. The user represents that it is a legal entity, affiliated to a university and is not under any legal or other obligations, which limits itself to comply with these terms or to use the services subscribed with minimal risk of harm to yourself or others. You further represent that you are not registering the products/services for sharing / selling the student’s data to others under any circumstances, nor you can share your login credentials to others who wish to get student’s data.
  15. All changes / modifications made by the user to the data / information shall take place with immediate effect as the best possible case. But it can take more time than anticipated due to reasons not attributable to kpathway like visitor traffic, multiple users trying to register at same time, multiple user trying to access their account etc. but not limited to. Kpathway.com exempts itself from holding itself responsible for additional time / non updation of changes / modification getting updated, but not limited to, as you may have anticipated. We request to retry after some time. In case of repeated issues, please write to – info@kpathway.com along with screen shots of error messages.
  16. The user agreement between a user/subscriber and KLA will be treated as having been terminated in the following events: ( i ) On completion of the term for which the user/subscriber engages the services of the website; or ( ii ) In case the user/subscriber violates any of the conditions of this agreement or any other agreement entered into by him with KLA, however, such termination will be at the option and discretion of KLA; or ( iii )On writing and on such terms as agreed to by the parties mutually.
  17. Please ensure you do not create a duplicate entity either by mistake or by other means like altering the name etc. This can be considered as fraudulent act & can attract appropriate actions from KPathway like deletion of all the accounts, taking legal actions etc.

 Student / Candidate –

  1. The information/data fed by the user can be updated / modified by the user alone.   3. KPathway neither guarantees nor offers any warranty about the credentials, bonafides, status or otherwise of the prospective employer/organization which downloads your document / insertion or information/data and uses it to contact the user.
  4. KPathway would not be held liable for loss of any data – technical or otherwise, or of the information/data or particulars supplied by user due to acts of god as well as reasons beyond its control like corruption of data or delay or failure to perform as a result of any cause(s) or conditions that are beyond KPathway’s reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.

It shall be sole prerogative and responsibility of the user to check the authenticity of all or any response received from the employer pursuant to the document/ insertion or information/data fed / being fed into the network system of KPathway by the user. KPathway assumes no responsibility in respect thereof and expressly disclaims any liability for any act, deed or thing which the user may so do, pursuant to the receipt of the response from any employer, if any, to the document/ insertion or information/ date fed / being fed into the network system of KPathway.
  6. Uploading of multiple resumes by the same individual, using the same or different accounts shall entitle KPathway to remove the Resumes & delete the account without notice to the subscriber. This service is only meant for freshers / final year college students looking for suitable jobs through V campus. Any usage with commercial intent is prohibited.
  7. KPathway reserves its right to reject and delete any document/ insertion or information/data fed in by the user without assigning any reason.
  8. This service entitles the user alone i.e the same person, to add modify or change the data/information fed in by him but does not entitle him to use the service to feed fresh insertion or information/data /resume of another person in place of the insertion or information/data already fed in by such user.
  9. The user shall be sent email verification link during registration process. Also, they need to set their account login password by clicking to the link. This shall enable the subscriber to access and upload their personal & academic data with necessary documents. Once registered, the sole responsibility of the safe custody of the login credentials shall be that of the subscriber and KPathway shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse or manipulation / changes of data or document/s through misuse of the password and any damage or leak of information and its consequential usage by a third party. KPathway undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber. Also the user should not share their user id, password & account information with anyone.
  10. When you indicate your interest in a getting connected with any probable employer, kpathway.com, you are sending uploading your CV and application information including relevant documents to www.kpathway.com, and you are requesting and authorizing www.kpathway.com to make available such information to the probable Employer(s) who are registered with us..
  11. You understand that every employer have their own recruitment process, set of requirements for a particular job profile etc. By using V Campus at www.kpathway.com, you agree that www.kpathway.com is not responsible for the content of the Employer’s application form, messages, screener questions, testing assessments; required documents, or their format or method of delivery, recruitment process, salaries, training needs etc but not limited to. Hence dispute in this regards shall not be entertained by KPathway.

You consent to your application, documents and any responses sent to you by the Employer or vice versa through www.kpathway.com being processed and analyzed by www.kpathway.com according to these terms of use and www.kpathway.com’s Privacy Policy. Www.kpathway.com shall store and process such information regardless of whether a job vacancy has been filled.

Information you post in public areas of www,kpathway.com or applications or make visible in the resume and profile database may be accessed, used, and stored by others around the world, including those in countries that might not have legislation that guarantees adequate protection of personal information as defined by your country of residence. We do not have any mechanism to disable this visibility; hence the user has to be sure they wish to take up this service. KPathway.com shall not be responsible for insertions / data being accessed by its registered employers
  15. Although KPathway will make all possible efforts to adhere to these privacy settings, it will not be responsible for a profile being seen by a blocked user for any reason.

We recommend that you read the privacy settings carefully and KLA will not be held responsible for contacts/mails received by you

  24. KPathway offers neither guarantee nor warranties that there would be a satisfactory response or any response at all once the profile is submitted & visible to employers when they search relevant criteria.
  25. It is the responsibility of Job Seekers to verify the correctness and authenticity of the claims made by recruiters. We merely act as facilitators and do not act as agents for any recruiter.
  26. Payments to recruiters are not advised and shall be at your own risk.

  9. The employer will get access to the students personal, academic data & documents once they get themselves registered with kpathway.com at V campus. Employer can view as well as save student’s data in PDF format. Securely handling & storage of this data & ensuring that they are not misused is the sole responsibility of the employer.
  10. The employer may make job offer to candidate/s. Taking up or rejecting the offer shall be at the sole discretion of the candidate. There could be a possibility that candidate may accept your offer but later reject it. KPathway shall have no role to play in any of your recruitment process nor does have any control over candidate decision making. KPathway will not entertain any kind of claims / mediation request from Employer / candidate.
  11. Employer can contact the student if they wish to, for any recruitment purpose. Any communication (pertaining or not pertaining to employment) between student & employer will be their mutual affair & KPathway will have no role to play in it, nor will entertain any sort of claims / complaints from any party incase of foul play by either party.

  1. KPathway does not have any service wherein the resume or profile of any student gets highlighted / is specially displayed on our website or so, such that it is being given special treatment. Nor we send any profile to any employer as a special case.
 Spam / Fraud offers – 
  1. It is possible that user/s might receive spam / fraudulent email or calls from person/s disguised as an employee / agent of KPathway like providing jobs, special consideration to profile etc. KPathway request its users to be vigilant & refrain from taking any service/s which is / are not displayed on our website kpathway.com.
  2. We insist user/s to report us immediately at – privacy@kpathway.com with details & refrain from making any sort of payments

 

Genuine Registrations only- 

 
  1. It is understood that the users (college / students / employers) are genuinely interested in this initiative & wants to be part of this.
  2. We, KPathway, hereby makes a strong statement that dummy and/or fraud user/s (college / students / employers) should not register on this platform. If such users are found, KPathway is entitled to take necessary legal action including filing a police complaint against such users.

  1. KPathway agrees to provide the service to the subscriber only for the duration or the number of impressions contracted for, to the best of its ability.

The Banners displayed on www.kpathway.com shall be prepared as per the instructions received from the users, KPathway shall not be responsible for the users misappropriation of the Trade Mark/ Copyright or any other Intellectual Property Right sought to be passed of as that of the user.

The use and access to V Campus database is subject to this policy. The services provided to you are aimed at providing recruitment solutions and should be restricted to contacting suitable candidates for genuine jobs in existence.

Mailing practices such as transmitting marketing and promotional mailers/ Offensive messages/ messages with misleading subject lines in order to intentionally obfuscate the original message, are strictly prohibited.

We reserve the right to terminate services, without prior notice, to the originator of Spam.

  • KPathway also exempts itself from any sort of liability arising out of following but not limited to:

    • False / non genuine / misguiding documents uploaded by users – college students.
    • Breach / misuse of student’s data due to mishandling, insecurely storing of student’s data by employers.

REFUND POLICY

  1. Ours is an online academic platform through offering services through its website www.kpathway.com.
  2. We deliver trainings through live sessions or self learning sessions, provide Career guidance service for 8th to 12th grade schools students. 
  3. The customer gets service delivered on the date committed (in case of live sessions) or gets immediate access to our Learning Management System (for self learning courses or recorded contents) as soon as a person gets registered & makes necessary payments. Regarding Career Guidance Program, our Counselor gets in touch with the student within stipulated time from date of purchasing of this service and shall complete the delivery as per schedule mentioned in the program in respective packs.
  4. We do take utmost care in ensuring that the service gets delivered as per commitment.
  5. There could be a possibility that the training through live session could not be conducted due to any unforeseen / any circumstances. Under such circumstances, the student shall be informed about rescheduled dates & they can take up training accordingly. In case of cancellation of training from our side & non availability next date, K Pathway shall refund part or total fees at its sole discretion only.
  6. There could be a possibility that the student may not be able to access self learning course due to technical issues with platform. We shall be taking necessary efforts to resolve the issues in shorts possible time we can. We shall intimate the student about service restoration & then they can complete their course accordingly. We do not have any refund policy for this.
  7. We do not have any provision for cancellation of any of our paid service that have been purchased or subscribed to nor refund of payments under any circumstances (except cancellation from our side that too with our decision only).
  8. In case you have any issue, you are requested to write in to info@kpathway.com & we shall take utmost efforts to resolve your issue in shortest possible time.
